Child Injury – £4500 – Facial Injuries
01/12/2009Child accident and injury compensation claim example:
A child compensation, accident and injury claim was made when a pen was thrown by another child and struck the child’s face causing injury. A compensation claim was made by the child accident solicitors who acted on behalf of a child’s parents who obtained compensation for the child accident injury.
A child accident and injury claim was made when a 12 year old child struck by a pen thrown by another child at school. The injured child was playing in class with other children when the accident took place. The teacher went out of the room leaving the young children unsupervised. Within 5 minutes from the teacher leaving the class a pen was thrown by another child striking the infant insured’s cheek, just missing the child’s eye.
The injured child suffered a cut to the cheek requiring stitches. The child was traumatised by the accident. The injured child’s mother was called into the school to take the child straight to accident and emergency hospital for medical care.
The consultant explained to the parents about the nature of the injury following the child accident and advised that it would best be dealt with by stitches being applied. The child injury accident solicitors instructed a specialist consultant plastic surgeon report and advise upon the injury and consider if there was to be any permanent and lasting scarring tissue.
The plastic surgeon was of the view that within 12 months following the accident there would be a slight scar tissue only visible by close observation. There was to be no permanent injury or other problems associated with the injury.
Note that that mother who instructed the child compensation injury solicitors is known as a litigation friend. The compensation payment to the infant child was approved by the Court and the compensation to be invested on behalf of the infant child until the child reaches the age of 18 years. At that age the child then in law reaches majority and is able to obtain the compensation from the court with interest that has accumulated since the money was in court.
The child accident and injury solicitors acted on a NO WIN NO FEE agreement and recovered all legal costs off the insurance company. The infant child received 100% compensation and 0% legal costs which was approved by the Court.
