A child accident and injury claim was made when a 13 year old boy tripped and fell over a defective pavement. The child accident was caused by a defective paving slab that protruded above the surrounding paving stones by 1.5 inches. The injured child tripped and fell over the defect landing on his outstretched hands. The injury sustained to the child was a sprained wrist.
The injured child suffered with severe pain and was taken to accident and emergency hospital to see if the injured child’s wrist was broken. The x-ray results showed the injured child that there was no fracture to the wrist. The consultant explained that the injury was a sprain and recommended rest.
Whilst the injured child’s wrist was recovering he was unable to participate PE and sports. The child recovered from his injuries within 4 months.
The council admitted blame for the accident location. They failed to provide regular maintenance to the area where the accident occurred.

If the child needs money before the age of 18 years the parents can ask the court for money on account but must explain to the court why.
