03/12/2009

Child accident and injury compensation claim example:

Child accident and injury claim was made when a young child tripped and fell in the road due to a pot hole.  A compensation claim by accident solicitors who acted on behalf the child’s parents obtained £3500 compensation. Injuries sustained a hairline minor fracture to the foot.

A child accident and injury claim was made when a 13 year old boy was crossing the road to play on the park. The child tripped and fell due to pot hole in the road. The injured child sustained a fracture to the foot.

The injured child was in severe and was helped to his feet by his friends and dragged across to the pavement to avoid on coming vehicles. The injured child’s father rushed the child to accident and emergency hospital.

The x-ray results showed the injured child that he had a fracture to his foot. The consultant advised the injured child to rest his foot so that the fracture would recover in time.  The foot was suitably secured.

The injured child was absent from school for a 1 week.  He could not participate in sports and martial arts.

The local council responsible for the accident failed to admit liability as first but following negotiations by the child accident solicitors blame was conceded.

Child accident and injury compensation solicitors obtained compensation for £3500 for the child tripping accident. The child accident and injury solicitors acted on a NO WIN NO FEE agreement and recovered all legal costs from other side. The parents on behalf of the child received 100% compensation and 0% legal costs.

All parents will need to be aware that any child (that is a person under the age of 18 years) must have the amount of the accident compensation approved by the Court. The parent of the child called the “litigation friend” instructs the solicitors on the Child’s behalf to claim the child accident compensation. The Court will invest the child’s compensation until the child attains the age of 18 years.  The child can then request the compensation plus interest.  If the child needs money before the age of 18 years the parents can ask the court for money on account but must explain to the court why.
