03/12/2009Child accident and injury compensation claim example:
Child accident and injury claim was made when a young girl was injured due to a road traffic accident on the way to school. A compensation claim by accident solicitors who acted on behalf of the child obtained £5000. Injuries sustained whiplash to and minor head injury.
A child accident and injury claim was made when 12 year old girl was injured due to a road traffic accident. The child was on the school bus on the way to school. The school bus had braked heavily when a car pulled out in front of the bus. This caused the injured girl to strike her head on vertical bar immediately in front of the child. The accident to the child also caused her to suffer from whiplash injuries.
The injured child appeared to lose consciousness for a brief period. She was taken to hospital to receive medical attention. The injured child’s parents were told that their daughter would recover in time as the injury to the forehead was badly bruised and swollen but there was no serious injury or damage. It was confirmed she also suffered from whiplash injury. The parents were given suitable guidance concerning head injuries to children and to keep a watchful eye on her.
The injured child was hospitalised for 1 day for observations and was advised by doctors to rest at home until she was well enough to go back to school. The child was absent from school for a period of 2 weeks. The injured child also suffered from minor headaches. There was a full recovery from her whiplash injury within 14 months following the road accident.
Child accident and injury compensation solicitors obtained compensation in the sum of£5000 for the road traffic accident. The child’s parents also received compensation for expenses and loss of earnings.
The child accident and injury solicitors acted on a NO WIN NO FEE agreement and recovered all legal costs from other side. The parents on behalf of the child received 100% compensation and 0% legal costs.
All parents will need to be aware that any child (that is a person under the age of 18 years) must have the amount of the accident compensation approved by the Court. The parent of the child called the “litigation friend” instructs the solicitors on the Child’s behalf to claim the child accident compensation. The Court will invest the child’s compensation until the child attains the age of 18 years. The child can then request the compensation plus interest. If the child needs money before the age of 18 years the parents can ask the court for money on account but must explain to the court why.
