How much compensation for whiplash?

A school girl was involved in a road traffic accident. She was 12 years old at the time and a passenger in the front seat. The question arose as to how much compensation for whiplash she would receive if her whiplash injury lasted for a duration of about 6 months.

On the assumption that the school girl made a full recovery and there was no other injury save for minor “shock” or “travel anxiety” lasting no more than a few weeks the compensation for whiplash injury would be valued in the region of about £2,400 to £3,000 approximately.

This valuation does not take into account any out of pocket expenses and costs by the litigation friend or guardian as a direct result of the road accident.

Compensation for whiplash who to sue?

The question arises who is at fault for the child whiplash injury? If the other driver crashed into the vehicle and was 100% to blame then the issue is simple, the child injury whiplash solicitor would make a claim against the driver of the other vehicle. However if the car crash was due to the fault of the mother or father of the child (in whole or in part) the a claim for compensation would have to be made against the parents or guardian.
