01/12/2009

Child accident and injury compensation claim example:

A child compensation accident and injury claim was made when a child fell off a platform of a slide in a park. A child accident compensation claim by accident solicitors was made and they obtained £3500. Injuries sustained a simple fracture to arm.

A child accident and injury compensation claim was made when a 12 year old boy was playing at a park on the platform of a slide. The child was near the edge of the platform waiting to go down the slide until he fell off and heavily landed on the ground causing him to land on his right dominant arm.

The injured child was in severe pain and was taken to hospital to undergo an x-ray.  The x-ray results showed the injured child and his parents that there was a simple fracture to his right dominant arm. The injured child suffered severe pain and was kept at home from school for 1 week. Following the child accident, the child made a complete recovery from the accident within 6 months.

The accident was caused by defective slide guard rails. The guards were vandalised and had not been repaired.  There was evidence from other parents who had used the park that the defect went unnoticed for at least 3 months.

At first the council responsible for the accident denied liability but following the child accident solicitor’s letter and witness evidence produced at a later stage the council admitted blame.

Note that that mother who instructed the child compensation injury solicitors is known as a litigation friend.  The compensation payment to the infant child was approved by the Court and the compensation to be invested on behalf of the infant child until the child reaches the age of 18 years.  At that age the child then in law reaches majority and is able to obtain the compensation from the court with interest that has accumulated since the money was in court.

The child accident and injury solicitors acted on a NO WIN NO FEE agreement and recovered all legal costs off the insurance company. The infant child received 100% compensation and 0% legal costs which was approved by the Court.

Child Injury – £5000 – Dislocated Shoulder

01/12/2009

Child accident and injury compensation claim example:

Child accident and injury claim was made when a 4 year old girl tripped over a rug at nursery. A compensation claim by accident solicitors who acted on behalf of an infant child obtained £5000. Injuries sustained a dislocation to the shoulder.

The Child accident and compensation injury claim was made when a 4 year old girl tripped over a rug at a nursery. The young child fell heavily and awkwardly onto the floor.

She was not noticed straight away as there were only a limited amount of staff supervising the children. The injured child suffered severe pain and her mother had to come into the nursery to take her to accident and emergency hospital.

The consultant explained to the young child’s mother that she had dislocated her shoulder and that she would had to have constant attention to make sure the injured child would not aggravate her injury.  The child made an almost complete recovery within 10 months from the accident although there were occasional complaints of pain from the infant child which the child would recover within 18 months from the child accident.

The Council for the nursery admitted blame as the rug was inappropriately incorporated in the nursery causing an obvious tripping hazard to the children and to staff.

The Child accident and Injury compensation solicitors obtained compensation for £5000 for the trip and fall accident. The child’s mother (known as the litigation friend) also received compensation for expenses and loss of earnings.

The child accident and injury solicitors acted on a NO WIN NO FEE agreement and recovered all legal costs off the insurance company. The infant child received 100% compensation and 0% legal costs which was approved by the Court.

Child Accident Claims – Slip Wet Floor – Cut To Chin

15/07/2009

Child Accident Injury Cut to Chin

Child accident claims solicitors settled an injury to a child’s chin following a slipping accident.  The child aged 8 at the time of the accident slipped on a wet floor in  toilet and the child’s face stuck a sink unit. The child’s injuries was treated by the GP and Hospital.

The school child won the compensation claim.  The child did not attend school for 2 days after the accident and the cut healed within a few weeks.  Some 3 years after the accident the solicitors submitted evidence to the Judge at the court approval hearing that the cut was  no longer tender and that the child was not concerned about the appearance of the scar.  The scar measured about 1.cm by 0.1 cm and was flat.  The scar was permanent but would fade in time.

The child injury solicitors obtained compensation at the court hearing for £3,375 in full and final settlement of the child accident claims.

The compensation payment for the child will be invested until the child is 18 years of age.  For further information on investment of the child’s compensation claim see Court Approval Link.
